Sumeet inc  (the Organization) is the provider of the application Sumeet.pro (Service). Our basic service is free but you can upgrade to the paid service to access more advanced features. Sumeet will store data related to your meetings and any other content you upload from your account, as you use our Service. Our proprietary artificial intelligence powered speech and speaker recognition software transcribes your recorded meetings into text and then summarizes them automatically. Using our Service, you can also share these meeting summaries and notes with others. 

Terms of Service:

The following terms and conditions cover the use of all aspects of the Sumeet website (Platform) and related content, services, and products on our website. You can only access the Services on our Website once you accept all the terms and conditions mentioned in this page. Your acceptance for accessing our Service also includes other operating rules, policies such as Sumeet’s Privacy Policy, and other procedures we will publish via our website periodically. For the sake of convenience, all this data will collectively be referred to as the Agreement. 

Review this Agreement carefully before you access or start using the Website and our Services. Your access or use of any of our services will be considered an explicit acceptance of all the terms and conditions listed in this Agreement. If you do not agree to all our terms and conditions, you may not be able to access our Website or use any of our Services. 

Within the scope of this document, the terms “you,” “your,” “yourself” shall also include your employees, agents, business representatives and any other individuals that you allow to access our Services through your Account (as defined below). It is your sole responsibility to ensure that all concerned persons who access the Services through your account are made aware of these Terms and comply with them.

Electronic Communications

Whenever you visit our Website or send us e-mails, it is considered as your electronic communication with us. We also require your consent to send electronic communications to you. Our forms of electronic communication with you include sending e-mails to your inbox or publishing notices/updates on our Website. You must accept our terms of sending you communications in writing to satisfy any legal requirements. Your acceptance spans all agreements, notices, disclosures and other communications we provide to you electronically. 

Intellectual Property

Your use of our Website does not grant you the right or license to reproduce or otherwise use any Sumeet or third-party trademarks. These include: 

All content we feature on this website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, and its compilation. These are the exclusive property of Sumeet and are protected by international copyright laws. 

All the software used on this Website is the property of Sumeet or our software suppliers, and are also protected by international copyright laws. 

Other trademarks, service marks, graphics and logos featured in the Website may be trademarks of other third parties. 

Your Account Information

As you use our Website through your registered account, it is your sole responsibility to protect the confidentiality of your Sumeet account information (Account) and for restricting access to your device. You confirm that only you can be held responsible for any and all activities occurring under your account or password. At our sole discretion, Sumeet reserves the right to refuse service, terminate accounts, remove or edit content that you may access through your Account. 

Updating Terms and Conditions

At our sole discretion, Sumeet reserves the right to update any part of this Agreement. We recommend that you check this Agreement periodically for changes. You must continue to accept those changes to the Agreement if you wish to enjoy continued use of or access to the Website. We may also, in the future, add new services and/or features on our Website (such as launching new tools and resources). Such new features and/or services shall also be subject to the terms and conditions of this Agreement.

General Terms for Payment and Renewal

In addition to our free service, we also offer optional paid services on our Website. You can upgrade to these services at any time by making the necessary payment through your Account to access additional features. When you opt for our paid services, you agree to pay Sumeet subscription fees indicated for that service periodically (e.g., monthly, quarterly, or annually). Payments will be charged upfront from the day you sign up for an Upgrade and will cover the use of that service for the respective subscription period as indicated. Do note that these Upgrade fees are not refundable.

Automatic Renewal of Payment

You may cancel your subscription to our paid services at any time before the end of the applicable subscription period. However, if you do not cancel your subscription, your access to these paid services will automatically renew. You authorize Sumeet to collect the then-applicable periodic subscription fee for continuation of such Services (including any taxes) using any credit card or other payment method you have shared with us. 

Cancellation and Termination of Account 

You are solely responsible for ensuring the proper cancellation of your account. Upon canceling your account, all of your content will be immediately deleted from the Service and cannot be recovered again. All service charges accrued up until the cancellation date must be paid in full. 

Sumeet also reserves the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Sumeet service, for any reason at any time. In the event of such termination of the Service, your Account or access to your Account will be deactivated or deleted, and all the content in your Account will be forfeited and relinquished. At our sole discretion, we can refuse service to anyone for any reason at any time. 

In the event of such cancellation or termination of Service, all provisions within this Agreement will continue to apply, where relevant. These include, without any limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

General Representation and Warranty

When you accept our Terms and Conditions, you agree to use our Website and Service  in strict accordance with the Sumeet Privacy Policy, with this Agreement and with all applicable laws and regulations (including any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside). You also agree that your use of the Website will not infringe upon or misappropriate the intellectual property rights of any third party.

Indemnification

In the event of your violation of this Agreement or even as you use our Website, you agree to indemnify and hold faultless Sumeet, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees. 

Rules of Conduct

Your use of the Services requires you to follow certain rules of conduct. You must not:

Violate any applicable federal, state, local, or international law or regulation while using the Services;

Infringe upon or violate Sumeet’s intellectual property rights or the intellectual property rights of others who use the Services;

“Harvest” (or collect) information from the Platform through an automated software tool or manually on a mass basis (unless you have our explicit and separate written permission to do so);

Use automated means to gain unauthorized access the Platform or to any account or computer system connected to the Platform;

Obtain, or attempt to obtain, unauthorized access to areas of the Platform or our systems not otherwise accessible to you as a User;

“Flood” or overwhelm the Platform with requests or use the Services in any manner that could disable, overburden, damage, or compromise the Platform;

Circumvent or reverse engineer the Platform or its systems;

Manipulate or forge identifiers that mask the origin of any information you post on the Platform or otherwise provide to us or our employees;

Impersonate or attempt to impersonate Sumeet, a Sumeet employee, another user, or any other person or entity;

Introduce any viruses, trojan horses, worms, logic bombs, or other material which is considered malicious or technologically harmful;

Spam, phish, pharm, pretext, spider, crawl, or scrape;

Engage in any other conduct that prevent others from using our Services, harm Sumeet or our other users, or expose them to liability.

Your Responsibility

Sumeet’s Services allow you to record individual conversations and/or upload recorded conversations. The laws regarding the notice and notification requirements of such recorded conversations vary by location. It may be an offense in your jurisdiction to record other individuals without their prior written consent. You are responsible for following applicable foreign, federal and local laws when using such features. This includes informing the participants in your meetings that the discussion is being recorded. We do not condone the use of our Services for illegal purposes.

You and others that you record are solely responsible for any content that becomes part of the Customer Data. Any recordings of meetings through Sumeet, or data you upload to our Website through your account, including materials, recordings, videos, pictures, or files constitute Customer Data. When you use our Service to create or upload Customer Data, you affirm your responsibility that any processing of such Customer Data by Sumeet will not violate any applicable laws or regulations.

When you use our Services, you do so at your own discretion and risk and by agreeing that you will be solely responsible for Customer Data and the consequences of recording, submitting and publishing Customer Data on or through the Services.
